Creación del derecho en una sociedad global : ¿Importa todavía el consentimiento?

Abstract

This article analyzes the current conditions and requirements for the creation of the norms of international law, in light of the evolution experienced by international society and the concern caused by some manifestations that seek to establish a creation system that to some extent dispenses consent of States and other subjects of international law. We maintain that the expression of the consent of the States is also indispensable for the creation of norms of international custom and the delegation by the States of a decision-making power in international organizations. It also highlights that the process of creating regulations in international law must safeguard the requirements of the rule of law and the democratic principles on which the main national societies rest.
